Legal Visit Application

  1. How to make an appointment:
    (1) Go to Taichung Prison in person: Please provide required documents in person at the Guard and Control Section from 9 am to 11 am or 1:30 pm to 4 pm during workdays.
    (2) Via fax:
    • Please fill out and fax “Legal Visit Application Form” to the Guard and Control Section, then afterwards contact the section to make sure they receive it.
    • The application shall be applied one to seven days, during office hours on workdays, before the visit date you would like to appoint. If the day before the visit date falls on public holiday, then the application shall be applied no later than the day before the public holiday.
    • The appointment can be cancelled no later than one hour before the scheduled visit time by calling the section at 04-23891296 extension 212. However, if the lawyer or defense attorney is unable to come for the visit and fails to cancel the scheduled appointment over three times within six months, the prison might not accept his/her application for three months which begins from the most recent appointed visit date.
  2. Documents Required:
    (1) Defense Attorney: Attorney license and the power of attorney for criminal case (only required for the first time application) should be presented to the prison for verification, whereas identifications and the power of attorney are required for those who is not a qualified attorney but appointed as an agent in compliance with Code of Criminal Procedure.
    (2) Lawyer (Agent): Attorney license and the power of attorney for civil case or administrative case (only required for the first time application), etc., should be presented to the prison for verification, whereas identifications and the power of attorney are required for those who is not a qualified attorney but appointed as an agent in compliance with related procedure regulations.
    (3) Attorney who will be retained: Attorney license along with the documents concerning to being retained shall be presented, such as a power of attorney awaiting to be signed or a notice from Legal Aid Foundation to provide legal aid.
    (4) Intern: Identifications shall be presented while visiting the inmate with other lawyer or defense attorney.
    (5) The attorney seeking a legal visit is not appointed by the accused in restrictive detention shall present attorney license and the power of attorney to the prison to get advance approval from the concerned court for such a restriction case; otherwise, the attorney who is not appointed by the accused could also apply for advance approval from the preceding mentioned court and submit the approval to the prison when applying a visitation.

  4. Notice:
    (1) Food or other objects which are not in connection with the lawsuit should be sent to the inmate by following our general guidelines for sending items to a person in prison and are not allowed to bring in with the lawyer or defense attorney during their visit.
    (2) Using communication, video or audio recording devices is prohibited when visiting the inmate.
    (3) Any act involved shall not violate the Attorneys' Code of Ethics.
